Terms of Service

1. Introduction

Welcome to TryThatJob, a marketplace that connects individuals ("Triers") and professionals ("Hosts") (collectively, the "Users") offering career exploration and job shadowing experiences ("Experiences").

These Terms of Service ("Terms") govern your access to and use of the TryThatJob platform ("Platform"), operated by Vladyslav Muzhylivskyi Itentio, NIP 6751522794 ("TryThatJob", "we", "us", or "our"). By using our Platform, you agree to be bound by these Terms.

If you do not agree, please do not use TryThatJob.

2. Nature of the Platform

TryThatJob is a neutral venue for facilitating connections between Triers and Hosts. We do not own, offer, operate, or supervise any of the Experiences listed on the Platform.

We do not employ or contract Hosts, and we do not verify the accuracy, safety, legality, or quality of any Experience. All Experiences are independently provided by Hosts at their own discretion.

3. No Liability for Shadowing Experiences

By using TryThatJob, you explicitly acknowledge and agree that:

• •TryThatJob is not responsible or liable for the conduct, actions, omissions, or negligence of any Host or Trier before, during, or after any Experience.
• •We make no guarantees or warranties, express or implied, about the quality, safety, educational value, or outcomes of any Experience.
• •Any injury, loss, damage, or dissatisfaction resulting from participation in an Experience is solely between you and the other party.

You release TryThatJob from any and all claims, demands, or damages, known or unknown, arising out of or related to any interaction with Hosts or Triers or participation in any Experience.

4. Eligibility

To use TryThatJob, you must:

• •Be at least 18 years old, or the age of legal majority in your country;
• •Have full legal capacity and authority to enter into a binding agreement;
• •Comply with these Terms and all applicable laws.

We reserve the right to suspend or terminate access for any user who violates these Terms or whose conduct we deem harmful.

5. Host Responsibilities

Hosts are solely responsible for:

• •Providing a safe, lawful, and accurate Experience;
• •Ensuring appropriate conduct and professional behavior;
• •Managing their own schedule, availability, pricing, and expectations;
• •Complying with employment, tax, insurance, and workplace regulations in their country or jurisdiction.

TryThatJob does not vet, insure, supervise, or audit Hosts, and makes no representations or guarantees about their qualifications or environments.

6. Triers Responsibilities

Triers are solely responsible for:

• •Showing up on time and behaving professionally;
• •Following any on-site rules or guidelines;
• •Understanding the Experience is observational only and not a trial, internship, or employment;
• •Taking personal responsibility for their own safety, behavior, and outcomes.

7. Payments and Fees

• •All payments are processed securely via third-party providers (e.g., Stripe). Please refer to the third-party proviers terms available here (https://stripe.com/en-pl/legal/ssa) for any details regarding the processing of payments.
• •TryThatJob may retain a service fee on each transaction.
• •Hosts may be paid after completion of an Experience or as otherwise agreed.

We are not liable for payment failures, disputes, or unauthorized transactions.

8. Cancellation and Refunds

• •Users may cancel or reschedule bookings up to 48 hours before the Experience for a full refund.
• •Refunds for cancellations within 48 hours or no-shows are at the discretion of the Host.
• •TryThatJob reserves the right to issue refunds in cases of platform error or verified fraud.

9. Limitation of Liability

To the fullest extent permitted by law:

• •TryThatJob shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to personal injury, lost profits, or reputational harm, arising out of or relating to:
• •Any Experience or interaction between users;
• •Use of the Platform or inability to access it;
• •Any user content, error, inaccuracy, or technical issue.

Our total aggregate liability under these Terms shall not exceed the greater of: (a) $100 or (b) the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless TryThatJob, its officers, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of:

• •Your use of the Platform;
• •Your participation in an Experience;
• •Any violation of these Terms or applicable law.

11. Intellectual Property

All content, branding, and trademarks on TryThatJob are the property of TryThatJob. You may not copy, modify, or distribute any content without prior written permission.

12. Modifications to Terms

We may update these Terms from time to time. We will notify users of material changes. Continued use of the Platform after such changes constitutes your acceptance.

13. Confidentiality

By using the Platform, you agree not to disclose, share, or misuse any confidential or sensitive information obtained during your interaction with other users or through participation in an Experience. This includes but is not limited to personal data, business insights, proprietary methods, or any non-public information shared by Hosts or Triers. TryThatJob does not monitor or control the exchange of such information and disclaims any liability arising from breaches of confidentiality. Users are solely responsible for respecting privacy and maintaining discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland. All disputes shall be resolved in the courts of Poland, located in Kraków, Poland.
